Sexual Offender Definitions

Sex offenders classifications are determined by the courts and are placed in one of the following categories:

Sexual Predators - These are sex offenders who have been determined by the courts to be sexual predators. They must notify the county sheriff every 90 days for the remainder of their lives where they are living. It is then the responsibility of the county sheriff to notify segments of the community that a sexual predator is located in their neighborhood.
Child-Victim Predator - This category reports to the sheriff every 90 days for life. The county sheriff must notify segments of the community that a Child-Victim predator is located in their neighborhood. This category is for specified abduction type offenses committed WITHOUT sexual motivation.
Factors that are considered by a court to be labeled a Sexual Predator:
- Offender’s age
- Prior Criminal record, not just sex crimes
- Victim’s age
- Number of victims
- Use of drugs/alcohol to impair the victim/prevent resistance
- Offender’s mental illness/disability
- Nature of sex offense and whether it was part of a demonstrated pattern of abuse
- Offender’s display/threat of cruelty

Habitual Sex Offenders - This category reports to the sheriff once annually for 20 years and the sheriff may provide community notification only at the direction of the court. Although there are registered habitual sex offenders we have not been ordered by the courts to make any community notification.
Sexually Oriented Offenders - This category reports to the sheriff once annually for 10 years and there is no provision for community notification
Child-Victim Offenders - This category reports to the sheriff once annually for 10 years and there is no provision for community notification. These are specified abduction type offenses committed WITHOUT sexual motivation.
Habitual Child-Victim Offenders - This category reports to the sheriff once annually for 20 years and there is no provision for community notification. These are specified abduction type offenses committed WITHOUT sexual motivation.

Endangering Children (2919.22 (B) (5))-certain subsections; child is under 18 yrs.

Pandering Sexual Oriented Matter Involving a Minor (2907.322 (A) (1) or (A) (3))

Illegal Use of a Minor in a Nudity-Oriented Material or Performance (2907.323 (A) (1) or (A) (2))

Definitions: Anderson's Ohio Revised Code On-Line

A violation of any former Ohio law that is substantially equivalent to any offense listed above, including felonious sexual penetration.

An offense under an existing or formal municipal ordinance or law of another state or the federal government, or a violation under the law applicable in military court that is substantially equivalent to any of the offenses listed above.

An attempt to commit, conspiracy to commit, or complicity in committing any of the offenses listed above.
